This privacy policy (“Privacy Policy”) covers the data collection and processing activities of Escalante Outdoors, LLC dba 4Runner Lifestyle (hereinafter “we,” “our,” or “us”) in connection with www.4runnerlifestyle.com (the “Site”). This page is intended to act as a Notice at Collection (where required by applicable law) and includes information such as the categories of personally identifiable information (“Personal Information”) we collect, the purposes for which we use it, how it will be shared, and more. It applies when you avail yourself of any of our services, including by accessing and/or using the Site, purchasing our products, choosing to participate in any of our programs, or communicating with us in any matter (altogether collectively our “Services.”)

Please carefully read this Privacy Policy so that you will fully understand how your Personal Information will be treated. From time to time, we may change this Privacy Policy – please see the “CHANGES” section below for more.

By accessing, using, or availing yourself of our Services, you are consenting (where allowed by applicable law) to the practices described in this Privacy Policy as well as our Terms of Service, incorporated here by reference. 

CATEGORIES OF INFORMATION WE COLLECT

Typically, the Personal Information we receive comes when you interact with us directly. We collect Personal Information that you voluntarily provide when you use or access the Services, including when you purchase products or services, contact us with inquiries or product / service feedback, or create an account with us. We may also automatically receive certain information about you when you interact with our Services.

This information may include your name, email address, billing or shipping address, telephone number, payment information, and/or details relating to your purchase(s). We may also process any information you choose to provide us with in applicable communications, including those regarding our Services or feedback on our Services. We may also collect information such as your email or other contact information for marketing purposes, including information for text messaging or push notifications if applicable.

When you choose to create an account with us (where applicable) or participate in other services, programs and/or promotions, you may also provide us or third parties we work with information such as your name, an email or physical address, phone number, account credentials, vehicle model information, and/or any other information that we request or collect in order to effectively administer those accounts and programs. We may also process any information you choose to provide us with in connection with those accounts and programs, including saved favorites or preferences, rewards or payment information (including gift cards or promotions), and more. If you participate in our text messaging program (“Text Messaging Program”), we may collect Personal Information such as the content of any text message responses to us, any user or screen name you may provide, and/or your opt-out preferences. We may also collect Personal Information such as device availability for messaging, messaging history, your carrier, the country associated with the phone, message delivery status, and/or message error codes as part of the Text Messaging Program. Personal Information obtained through the Text Messaging Program will not be shared, sold, or rented to any third parties for their marketing purposes.

When accessing applicable Services from a computer or a mobile device, you may be asked to share your geolocation information with us. If you agree to the collection of location data, in most cases, you will be able to turn off such data collection at any time, including by accessing the privacy settings of your computer, browser, or mobile device.

If you apply for a job or business relationship with us (where applicable) you may be asked to provide more detailed Personal Information which will be specified at the point of collection and that we will use to evaluate your qualifications for applicable openings or positions. If you as an individual reach out to us in a business capacity, we may also process any information you choose to provide us with (such as your name and contact information).

We may also automatically receive certain information about you when you interact with our Services. This may include IP address, browser type, information about your operating system or network, time zone, some of the cookies that are installed on your device, internet browsing data such as what website, ads, or search terms referred you to our website, how you engage with our Site, marketing, or communications, your transaction history, and your general location. This information can help us understand how you use our Services, particularly our Site, and gives us the feedback we need to improve them. When you visit our Site or access applicable Services, we and/or third parties we work with may send cookies to your device or leverage various similar technologies including website applications, pixels, beacons, tags, etc. (hereinafter collectively “cookies”) to serve you. We and/or third parties may also use cookies to collect information. By using the Services, including the Site, you consent (where allowed by applicable law), to the use of cookies (including related technologies) as set out herein.

While the exact cookies can change from time to time, the applicable categories of cookies used by us or those we work with (collectively “we” or “us” for the purpose of this list) may include cookies that:

The Site is hosted by Shopify, and Shopify may choose to use its own cookies and tools to collect data. Shopify may also use automated decision-making to conduct risk and fraud screening.

We are not responsible for any Personal Information collected by third parties’ cookies from the Site other than our own.

Sensitive Personal Information

We may collect some sensitive Personal Information. What “sensitive” Personal Information is defined as depends on applicable law(s) but may include precise geolocation, certain account credentials, information about religious beliefs, health data or genetic data, and more. We or third parties we work with may process account information and passwords to provide the Services that you have requested. We do not disclose or collect sensitive Personal Information for any other purposes, nor do we collect or process it with the purpose of inferring characteristics about you or other consumers. How to limit and/or opt-out of processing of sensitive Personal Information, if applicable, is addressed below in the “YOUR PRIVACY RIGHTS” section.

NOTICE OF FINANCIAL INCENTIVE

From time to time, we offer programs that may be considered financial incentive programs, compensation programs, etc., under applicable law (“FI Programs”). FI Programs are generally offered in the form of optional rewards opportunities or programs. These FI Programs require a consumer’s prior opt-in, though the form of opt-in may vary. They generally reward consumers with personalized experiences, exclusive offers, or other rewards for making qualifying purchases or engaging in other activities, such as creating an account on our platform, signing-up for our marketing email and/or text messaging programs, and other limited-time promotional campaigns.

As set out herein in our Privacy Policy, we may collect Personal Information such as your name, contact information like email or phone number, account sign-up information, vehicle model information, and/or any other information specified at the time of collection in order to effectively administer the FI Programs. We may also process any information you choose to provide us with in connection with the FI Programs.

The value of Personal Information obtained by us in connection with FI programs may vary but is generally associated with, e.g., the costs we incur in offering the FI Programs, the increased brand engagement and consumer interactions, and/or the types of FI Programs provided.

You may withdraw from our FI Programs at any time as stated in connection with the specific program of your choice or by reaching out to us a sales@4runnerlifestyle.com, or as otherwise set out in the “CONTACT US” section below.

USE OF YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to help us use your Personal Information as described above. For example, we anticipate using information in any of the following manners:

  • To provide the Services you have requested;
  • To facilitate and process consumer transactions and interactions with us;
  • To improve the security, functionality, and use of our Services, including the Site;
  • To screen for potential risk or fraud;
  • To register and maintain an account for you, where applicable;
  • To communicate with consumers regarding products and services, including through text messages, push notifications, and email where applicable;
  • To market products and services, including through personalized advertising, products or services, and/or applicable communications;
  • To promote and administer consumer programs and other activities;

Please also note that several of these uses are administered by or with third parties and therefore may also be subject to the separate policies, terms and conditions of the applicable third-party provider. We are not responsible for any Personal Information collected by third parties from sites or services other than our own.

Where you have an account with us, some of the information collected for the above purposes may be tied to that account. We may link information we have collected, including your contact information, transaction history, preferences, etc., to your account to provide us with analytics, improve our services, and provide you with more personalized experiences.

SHARING YOUR PERSONAL INFORMATION

Personal Information we process may be shared with and/or stored by third parties to help us provide the Services and/or use your Personal Information as described above. For example, we may provide some of your Personal Information to a third-party delivery service in order to have your order delivered or to facilitate our communications with you.   • For assistance with communications, product reviews and feedback, and/or marketing purposes, including to help us better understand consumer preferences, concerns, and trends;
  • When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, comply with applicable laws, investigate fraud, or respond to government or other lawful request(s), and such disclosure is not otherwise prohibited by law;
  • To any other third party with your prior consent to do so;
  • If we are involved in a merger, acquisition, or sale of all or a portion of its assets, which change you will be notified of as necessary under applicable law(s); or
  • As otherwise required by law.

Some of this sharing may be facilitated by cookies or related technologies, which are discussed in more detail above in the “Cookies and Other Technologies” section. We do not sell Personal Information to third parties for monetary consideration. Personal Information obtained through the Text Messaging Program will not be shared, sold, or rented to any third parties for their marketing purposes.

Right to Opt-Out 

We do not sell Personal Information for monetary consideration. Where applicable laws define the “sale” of personal data more broadly than as an exchange for money, or if it is shared with a third party for cross context behavioral advertising or targeted advertising, you may have the right to opt out of the sale, share, and/or renting of your information by reaching out to us at sales@4runnerlifestyle.com.

THIRD-PARTY SITE AND SERVICES

Our Services may contain links to other third-party website which are not in our control and which have their own privacy policies. We are not responsible for these third-party sites. You visit them at your own risk, and we encourage you to read their privacy policies. For example, you may use a third-party payment option to pay for orders. The privacy policy and practices of that third party payment provider will apply to your Personal Information.

In addition, your browser may already contain cookies placed by third-party sites, including various social media platforms. We are not responsible for the Personal Information such cookies may collect or what they may do with it. Nor are we responsible for any Personal Information collected by third parties’ cookies from sites other than our own.

YOUR PRIVACY RIGHTS 

We strive to process your Personal Information in accordance with applicable data privacy laws, which create a variety of privacy rights for covered consumers. These rights may include:

  • The right to know about Personal Information collected in connection with you;
  • The right to access your collected Personal Information;
  • The right to have your Personal Information deleted (though some exceptions may apply);
  • The right to have your Personal Information rectified or corrected (if inaccurate);
  • The right to data portability;
  • The right to restrict use or processing of your Personal Information, including to limit use and disclosure of sensitive Personal Information where applicable;
  • The right to opt-out of (a) the sale or applicable sharing of your Personal Information and/or (b) any applicable automated decision-making or profiling; and

If your request is denied or if you feel that your Personal Information has not been handled appropriately according to applicable law(s), you may be able to appeal that decision. PRIVACY FOR CHILDREN

Our Services are not directed to or intended for use by children or minors as defined by applicable law (hereinafter “Minors”). We do not knowingly sell or share information from Minors. If it is determined that Personal Information has been inadvertently collected on any Minors without the necessary consent, we will immediately take steps to ensure that such Personal Information is deleted, or, in the alternative, that the necessary consent is obtained for the use and storage of such Personal Information. Any Minors must seek and obtain parent or guardian consent to use the Services. Although we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee absolute security. OUTSIDE THE UNITED STATES

This Privacy Policy is intended to cover collection of information from residents of the United States and is not intended for consumers located outside the United States. If you are accessing the Site or our Services from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States. By accessing and/or using the Service you agree to this transfer (where allowed by applicable law).

CHANGES

We reserve the right to update this Privacy Policy from time to time to reflect, for example, changes to our practices or for other operational, legal, or regulatory reasons. If we make material changes to our practices, we will indicate them here as required by applicable law and we may also notify you elsewhere if required by applicable law.
